These Terms of Service are mutually agreed to by and between Isomnio, Inc. dba 17hats, a California corporation (“17hats”) and you.
Unlike most terms of service documents, this one is intended to be as easy to read and understand as possible. Our goal is to clarify what you can expect from 17hats, and what we’ll expect from you. Don’t worry, it’s nothing too crazy.
By using the 17hats (“Service”) in any way you are agreeing to be bound by the following terms and conditions (“Terms of Service”). So, if you don’t agree to these terms and conditions, you shouldn’t use the service.
17hats reserves the right to continue to update this document to make it better. If you see something confusing or have questions, please feel free to contact us by opening a direct chat with our support team.
You must be a human being older than 13 years of age, not a “bot” or anything similar. Sorry!
It is your sole responsibility to maintain the confidentiality of your password and account. If you forget your password, we can send you a link to let you reset it.
Your login should only be used by one person - using one login between multiple people is not advised. You may create up to four additional logins, for a total of up to 5 team logins including your own.
You are responsible for all content posted and any activity that occurs within your account (even if this content is posted by someone else who has their own login under your account).
The best way to get support for our Service is via direct chat. Click on the small green icon in the lower right side of your screen and start a new conversation. This will provide the quickest way to resolve any issues or questions you may have. We promise to be really nice and do our best to help you quickly.
Technical support is only provided via direct chat or via email (firstname.lastname@example.org).
At a minimum, 17hats may suspend or cancel your account without advance notice for any conduct that involves the use of abusive, derogatory, insulting, threatening, vulgar or similarly unreasonable language or behavior directed at any of our employees, representatives, or customers, whether it be in person, over the phone, or in writing.
Our Service is provided on an “as is” and “as available” basis. We do not guarantee and are not liable for any failure to access or store your data on our Service at any time. Like all cloud-based applications, we are vulnerable to the inherent unreliability of the Internet. That’s just reality.
However, we do pride ourselves on reliability. We use modern cloud computing services for our technical infrastructure, which are robust, redundant and reliable. We also monitor the status of the Service closely so that we can take prompt action in the case of an outage. So, we’re doing our best to keep the Service working at full capacity.
Our Service is provided without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability (whatever that means) or fitness for a particular purpose. Without limiting the foregoing, we make no warranty that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The Service will make you smarter, sexier, or in any way more appealing
- The results that may be obtained from the use of the Service will be effective, accurate, or reliable
- The quality of the Service or materials purchased by you will meet your expectations or be free from mistakes, errors, or defects
- Any errors or defects in the Service will be corrected
Our Service could include technical or other mistakes, inaccuracies, or typographical errors. We may make changes to the materials and services, including the prices and descriptions of any software or products listed, at any time without notice. Our Service materials may be out of date, and we make no commitment to update such materials or services. We know this makes us sound like we could be total losers, but really it’s just us covering all of our legal bases.
The use of our Service, the Service materials, or downloading any materials through our Service is done at your own discretion and risk and you agree that you will be solely responsible for any damage to your computer system or loss of data that results from such activities. And if you figure out a way to wipe out your computer just by using our Service, well...that would be pretty impressive!
Some states or jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you (we’re looking at you, Mississippi).
17hats has made best efforts to ensure the accuracy of this website, but is not responsible for any errors, typos or facts omitted. It is the member’s responsibility to ensure the service fulfills the member’s needs prior to paying for a subscription.
Use of the Service requires payment in advance. If at the conclusion of your initial subscription term you fail to pay for additional usage, your account will be suspended and inaccessible until payment is made.
See the website for current subscription fees. Your subscription will renew automatically at the end of the standard monthly, annual, biannual, or other pre-determined billing cycle that coincides with the end of your subscription term. That just keeps things simple. Note that there may not be any notice of this pending renewal prior to the actual renewal. Please refer to the “Billing Info” screen (in Account Settings) for information about your renewal date. You will receive a payment confirmation after subscription renewal.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
You are solely responsible for properly canceling your account. An email, direct chat, or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by clicking on the Account Settings link at the top of the screen and then clicking on the “cancel account” link in “Billing Info.” It’s that easy!
If you cancel your account before the end of your current paid-up term, your termination will take effect immediately and you will not be charged again. Your account will remain active until the end of the current billing cycle, but you won’t be entitled to a refund or prorated adjustment. (Sorry.)
If you cancel your account, your account access will be limited to the end of the current paid term. After that ends, 17hats will maintain your content for at least one month – so if you reactivate your account, your content will be as you left it. After 45 days, 17hats may, at our sole discretion, delete all of your content; once this content is deleted, it will not be recoverable. Once your active subscription ends, your content will no longer be accessible, so we advise exporting any reporting, contact lists, or important documents prior to the end of your subscription.
Subscription fees are processed in United States Dollars, and any approved refunds will also be processed in United States Dollars. No accommodation will be made for any differences that occur due to currency fluctuations between the date of the original charge and the refund date. We reserve the right to temporarily suspend or cancel your account if your usage significantly exceeds the average usage of other Service customers. Of course, we’ll reach out to you before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.
17hats, in its sole discretion, has the right to suspend or terminate any account and refuse any and all current or future use of the Service for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your account.
If you violate any of the terms in this document, your account may be terminated without notice. We may immediately deactivate your account and prevent access to all of your data on this site, including content that you have published for public use, without prior notice or liability to you. (This has never happened, and we hope it stays that way. But, still…).
If you think we removed your access by mistake, please get in touch and we’ll check it out right away! We’re pretty nice, and very reasonable, we promise.
Our Service (excluding any linked sites) is controlled by us from our offices within the state of California, in the United States of America. Our Service can be accessed from all 50 states (including Mississippi), as well as from other countries around the world, except possibly North Korea – we hear they’re still working on it. As each of these places have laws that differ from those of California (particularly North Korea, am I right?!), by accessing our Service you agree that all matters related to the use of our Service shall be governed by the statutes and laws of the State of California, without regard to the conflicts of laws or principles thereof. (Our lawyers sure earned their pay on that one!)
You also agree and hereby submit to the exclusive personal jurisdiction and venue of any court or competent jurisdiction within the State of California with respect to such matters.
You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction, including but not limited to copyright laws.
You understand that 17hats uses hosting partners and third party systems to provide necessary technology required to run the Service, and additionally, that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You must not modify, adapt, or hack the Service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by the Company.
You understand and agree that 17hats shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if 17hats has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.

Any new features/components that change or enhance the current Service, including the release of new components and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
17hats reserves the right to modify or close, temporarily or permanently, any part of the Service with or without notice.
Prices of all Services are subject to change. Notice may be provided at any time by posting the changes to the 17hats site or the Service itself. Subscriptions with “grandfathered-in” plans (prior to April 14, 2021) will continue to be renewed at the same rate as long as the original plan remains continuously active.
17hats shall not be liable to you or to any third party for any modification, price change, suspension or closure of the Service.
All content posted on the Service must comply with U.S. copyright law.
We do not claim intellectual property rights over the material you add into the Service. All materials uploaded remain your own.
17hats does not pre-screen content, but retains the right (but not the obligation) to remove any content from the Service if deemed necessary.

These Terms constitute the entire agreement between you and 17hats with respect to your access and use of our Service, superseding any prior agreements between us (including any prior versions of these terms).
The failure of 17hats to enforce or exercise any right or provision of these terms of service shall not constitute a waiver of that right or provision – so there’s that.
